These Terms and Conditions ("Terms") govern your access to and use of the SystemForces platform, website, and related services (collectively, the "Service") operated by SystemForces ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1 Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2 Description of Service

SystemForces is an interactive platform for learning system design through:

• A visual, drag-and-drop architecture canvas with infrastructure building blocks
• Story-based challenges with progressive constraints and levels
• A deterministic simulation engine with traffic modeling and failure injection
• Multi-metric scoring across latency, availability, cost, and complexity
• Leaderboards, profiles, badges, and gamification features
• Educational course content and quizzes

The Service is provided on an "as-is" basis. Features may be added, modified, or removed at our discretion.

3 Account Registration

To access certain features, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4 Subscriptions & Billing

Starter Tier: Access to beginner challenges, basic blocks, standard simulations, and leaderboards.

Pro Tier: A paid subscription (~$10–15/month) that unlocks advanced scenarios, optimization mode, detailed failure analysis, replay history, certificates, advanced blocks, and hidden failure cases.

• Subscriptions are billed monthly or annually as selected at checkout
• Payments are processed by third-party payment providers
• You may cancel at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis; contact help@systemforces.com
• We reserve the right to change pricing with 30 days' notice

5 Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble the simulation engine or scoring algorithms
• Scrape, harvest, or collect data from the Service without permission
• Interfere with or disrupt the Service or servers
• Impersonate another person or misrepresent your affiliation
• Share or redistribute Pro content to non-subscribers
• Use automated tools (bots, scripts) to interact with the Service, except approved APIs
• Harass, abuse, or harm other users

Violation of these rules may result in immediate account suspension or termination.

6 Intellectual Property

All content, features, and functionality of the Service - including but not limited to the simulation engine, scoring models, course content, design system, graphics, logos, and software - are owned by SystemForces and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission, except for personal, non-commercial learning purposes as intended by the Service.

7 User-Generated Content

Architecture designs, challenge submissions, and profile information you create ("User Content") remain yours. By submitting User Content, you grant SystemForces a non-exclusive, worldwide, royalty-free license to:

• Display your submissions on leaderboards and public profiles (where opted in)
• Use anonymized, aggregate data for analytics and product improvement
• Feature exceptional designs in marketing or educational materials (with attribution)

You are responsible for ensuring your User Content does not violate any third-party rights.

8 Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Results from the simulation engine will match real-world production outcomes
• Content is accurate, complete, or up-to-date for all architectures and use cases
• The Service will meet your specific requirements

SystemForces is an educational tool. It does not replace professional engineering judgment, consulting, or real-world testing.

9 Limitation of Liability

To the maximum extent permitted by applicable law, SystemForces and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

• Your use of or inability to use the Service
• Any unauthorized access to or alteration of your data
• Any third-party conduct on the Service
• Any errors, bugs, or inaccuracies in the Service

Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

10 Indemnification

You agree to indemnify, defend, and hold harmless SystemForces, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11 Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time through your account settings or by contacting us.

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data after a reasonable retention period
• Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination

12 Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against SystemForces.

13 Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email at least 30 days before taking effect. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
